by e-mail (before a contract between us exists).
Specification, description and price of individual goods can change, if
this is the case you will be notified before a contract between us exists.
Our acceptance of your order is subject to satisfactory completion of
our internal security checks. Where a problem occurs you will be notified
by email.
If your item is not in stock, we will back order for you. You will always
be emailed with the option to cancel your order if you would rather not

a separate service and is invoiced as such.
During your order we will present you with a selection of delivery methods,
you will be invited to select the option most fitting your purchase and
your requirements.
Nearly all goods that are in stock are dispatched same day (via your delivery
choice). In conjunction with your consumer rights in the unlikely event
an item was not delivered within 30 days you would be entitled to pull
out from the contract between us at no cost.
For the purpose of order processing our standard cut off is 4pm, following
this, the order rolls over to the following working day.
In most cases we do not bill you until we have dispatched the goods unless
agreed with you before hand.
Your right of cancellation
Distance Selling Act
You have the right to cancel the contract relating to your order at any time
up to the end of 7 working days after you receive the goods. To exercise
your right of cancellation, you must give written notice to us by letter,
fax or email giving details of the goods ordered and date received. Notification
by phone is not acceptable. If you exercise your right of cancellation
after the goods have been delivered to you, you will be responsible for
returning the goods to us at your own cost. Returned items must be packaged
properly. It is your responsibility to ensure returned goods are fully
insured. All returned goods must be in reasonable condition including
all internal packaging, cables, manuals, drivers and protective bags.
Gladiator Computers cannot take responsibility for goods that are damaged
or lost whilst being returned. On successful receipt of your return we
will refund you within 30 days for any sum that has been paid by you or
debited from your credit card for the goods (carriage is invoiced as separate
service deemed complete upon your receipt of the goods). If you do not
return the goods as required, we may charge you a sum not exceeding the
direct costs of recovering the goods. The goods must be returned to our
returns address with a valid RMA number to ensure effective processing.
Exceptions to Distance Selling Act
You do not have the right to cancel the contract under the Distance Selling
Act if: - the goods were delivered outside the UK, or if the order is
for computer software which has been unsealed, or if you are not a consumer
i.e. a company, partnership, sole trader or any other commercial body
or registered charity.
Any orders where goods are collected will be handled as counter sales
and are exempt from the Distance Selling Act.

Compatibility
Applications, drivers/BIOS and games are often released to market with
bugs that can affect hardware performance. As a result Gladiator Computers
cannot guarantee that every hardware product is 100% compatible with every
software product available.
Returning Faulty Goods
Please take reasonable care to ensure returned goods are actually defective
and the problem experienced is not caused by another component in your
system or by software configuration. If after having received Technical
Support information you are completely satisfied you have faulty goods
you must request an RMA number (Return Merchandise Authorisation) from
our customer service team.
RMA numbers are issued for specific components only. Do not return your
whole order because you believe one component may be faulty. If you do
not have the facility/expertise/knowledge to test the products yourself
we may offer additional service at agreed costs.
If a hardware defect is confirmed we will provide a suitable remedy dependable
upon the circumstances. If after our examination we dispute the failure
we will contact you to discuss.
With the exception of the confirmed defect itself, the condition of the
goods will relate to the remedy we are willing to offer, it is often useful
if you do keep packaging and accessories.
As a suggestion to resolve any problems if a dispute arrives as to a product
being defective or not it can be settled by an independent third party.
As a member of the PC Association we recognize their technical panel as
experts and will adhere to their findings. The cost will be met by whichever
party is incorrect.
Modified Goods
Any goods that have been modified or physically altered in any way may
be excluded from the warranty we are able to offer. If unsure please contact
us before you attempt an RMA for further clarification.
Packaging
Returned items must be packaged properly. It is your responsibility to
ensure returned goods are fully insured. Gladiator Computers cannot take
responsibility for goods that are damaged or lost whilst being returned,
even if faulty.
Testing
All returned items are tested by Gladiator Computers technicians. It is
essential that goods are tested as approximately 50% of all received returns
are tested not faulty. It is therefore important that you include a detailed
description of the problems experienced. Any item found to be not faulty
will be subject to a £10 charge if collected or a £10 + return
shipping charge if shipped back to the customer. You will be notified
by e-mail before any non-faulty goods are returned to you.
